Tuesday, Chief Justice of Pakistan Umar Ata Bandial overturned Attorney General of Pakistan Usman Awan’s argument that the bench should not consider the PTI petition because it was a “technical problem” that should be brought up in a different case.

The Election Commission of Pakistan’s decision to push back the election for the Punjab Assembly to October 8 is being contested in a petition filed by the PTI.

The petition is being handled by a five-member bigger bench, which is led by the chief justice and consists of Justices Ijazul Ahsan, Munib Akhtar, Aminuddin Khan, and Jamal Khan Mandokhail.

The chief judge urged the AGP, “Don’t ruin the situation on technical grounds. Elections are vital for democracy. “The March 1 order of the Supreme Court has already been carried out. Don’t bring up this subject or bring it up in court once more.

The chief justice welcomed General of Pakistan (AGP) Usman Awan at the beginning of the hearing and expressed the court’s eagerness to provide support for him.

Asserting that the proceedings were dismissed by a majority of 4-3 and that the chief justice of Pakistan did not have the authority to restructure benches without the consent of the individual judges, Justices Syed Mansoor Ali Shah and Jamal Khan Mandokhail on Monday questioned the ruling made in the March 1 suo motu regarding elections in Khyber Pakhtunkhwa and Punjab.

The attorney general questioned the petition’s maintainability while referencing the contrasting opinions of fellow judges. As two justices from the Supreme Court of Pakistan published a comprehensive decision in which they decided that the earlier suo motu in the subject was rejected 4:3, he contended that the Lahore High Court should be asked to hear the election-related case.

According to him, the LHC did not grant the president the power to reveal the election’s date. Moreover, the AGP asked the court to appoint a full bench to hear the matter.

The chief justice Bandial, however, ruled that the two justices’ opinions were not pertinent to the current case.

The attorney general said, “If the decision was 3:4, then the ‘breached’ directives do not exist. He continued, pleading with the court to first resolve the problem of the Supreme Court’s March 1 orders, “In reality, if there were no court orders, then the president had no right to even designate an election date.”
