A petition contesting the Election Commission of Pakistan’s (ECP) notification for conducting delimitation of seats was filed on Monday, and the Lahore High Court (LHC) has ordered the federal government to respond by Friday, October 19.
Petitioner Muhammad Muqsit Saleem claimed that the Elections Act forbade any delay in holding elections for longer than 90 days.

The ECP argued that the petitioner was not a relevant party during the hearing, which was presided over by Justice Abid Aziz Sheikh. Justice Sheikh has also requested the presence of Pakistan’s attorney general in court.

Petitioner requested that the ECP’s August 17 notification be ruled illegal.
In addition, he asked that the relevant authorities take lawful action to ensure elections were held within 90 days, as required by the Constitution. This was in clear violation of the notification’s unlawful requirements.

He also asked that the notification be put on hold while a decision was made.

According to the petitioner, elections would be postponed for longer than the 90 days allowed under Article 224 of the Constitution and Section 17(2) of the Elections Act because of the notification’s allocation of broad powers for redistricting.

He claims that the commission announced the boundaries of the constituencies on August 5 of last year.

He explained that the responsibility of the caretaker government was to ensure the security of the elections and that they were conducted in a free, fair, and transparent manner.

It is normal for the mandate of a caretaker administration to expire if elections are not held within the term established by the constitution.

The petitioner contended that, in light of the current political context, it was difficult to resolve any legal or constitutional questions without rigorous scrutiny.

Both a 90-day and a 60-day election timeframe are established by the Constitution. According to Article 224(1), elections for the national or provincial legislature must be held no later than 60 days after the end of the assembly’s term. According to Article 224(2), a general election must be called within 90 days of the dissolution of the National parliament or a provincial parliament, and the results must be announced no later than 14 days after the polls close.
