ISLAMABAD: Justice Miangul Hassan Aurangzeb of the Islamabad High Court has directed the Federal Investigation Agency (FIA) to examine Manzoor Pashteen, a leader of the Pashtun Tahaffuz Movement (PTM), while he is in prison, about the specifics of the accusations against him.
The defense attorney, Ataullah Kundi, informed the court that the FIA was planning to re-arrest Pashteen and his co-defendants once they were released on bond. According to Justice Aurangzeb, the law states that once an individual is arrested, the matter must be continued.
The court went on to say that it was absurd for the authorities to wait for an exonerated defendant to reappear before making another arrest. He elaborated by saying that a suspect in one case may be essential to another, and that both investigations could culminate in a prison sentence.
According to Justice Aurangzeb, the high court had already decided on an arrest in a previous instance. “The decision of the court becomes final if it is not challenged,” he further stated. The attorney stated that Pashteen was entitled to bail since he had been detained since December 7.
The matter was not being concluded, the judge said. If the administration were to change in the future and an investigation were to occur, he cautioned the cops not to do anything that could damage their careers.
The court threatened to close the case unless the FIA completed their probe while incarcerated. Subsequently, the hearing was postponed.
