In a case challenging the recruitment, the Islamabad High Court (IHC) issued a restraining order against federal police recruitment from other provinces on Saturday. The court ruled that the police recruitment process should continue, but that the 50% quota for other provinces in the federal police should not be met until the case is decided.
The court might decide whether to hire successful candidates whose homes are in Islamabad.
The court sent notices to the parties and asked for their responses. On September 23, it also asked the Attorney General and Advocate General of Islamabad to help.
On the petition of Barrister Yawar Gardezi, Justice Mohsin Akhtar Kiyani issued a written order stating that the petitioner claims that Article 25 of the Constitution talks about equality, that the Supreme Court has repeatedly declared Islamabad to be a federal unit, and that the Constitution also acknowledges Islamabad’s separate status as a federal unit. In the same way that people from other provinces have the right to work in their own province, people from Islamabad also have the right to work in Islamabad.
The lawyer argued that there should be no quota for other provinces when institutions in the Islamabad Capital Territory hire people. The petition argued that the Civil Servants Rules 15 and 16 quota for grade 1 to 15 recruitments in federal institutions located within Islamabad should be eliminated. In central government foundations whose ward is the nation over, Islamabad’s quantity ought to be distributed in grade 16 to 22 opening, while the amount for different regions in Islamabad Police and Islamabad Area Legal executive ought to be nullified, the solicitor further argued.
