Athar Minallah, Chief Justice of the Islamabad High Court (IHC), expressed disapproval of the country’s judicial system on Monday and lamented the absence of the rule of law and the “rule of the elite” there.

Speaking at a full court hearing held in his honor, the IHC CJ said it was unfortunate that the state had not upheld its obligations.

The courts have repeatedly emphasized in their judgments that there is no supremacy of law and that law is primarily for the elite, he emphasized, adding that we lived the first half of our lives under dictatorships.

Additionally, he counseled lawmakers to settle their differences in parliament as opposed to the courts. He claimed that instead of taking their disputes to court, the political leadership should have handled them in the legislature.

“There is no civic or constitutional primacy,” is the response to the inquiry. He continued, “The only rule that exists in this place is the rule of the privileged.

“A shift in perspective is related to the application of the law. The constitution’s execution can be strengthened through political leadership.

He added that the level of public confidence in the legal system may be used to measure the performance of the judiciary. Political leadership may help the constitution be more effectively implemented, he said. “Our institutions are subject to public scrutiny, and the public should have faith in the judiciary.”

The separation of powers is a principle that the judiciary must uphold. We took an oath to uphold the constitution, he said.

He emphasized that the IHC was unique among high courts in that it served as the voice of the federation. He added that he would not claim any credit for his accomplishments because they could not have been made possible without the support of his colleague’s judges and a thriving legal community.

In the meantime, Justice Amir Farooq, who would succeed Justice Minallah as the chief justice of the IHC, congratulated IHC CJ in a statement on the occasion.

He claimed that Justice Minallah was crucial to the attorneys’ movement, paid close attention to matters involving human rights, and helped to make jail changes possible.

Other speakers at the event were the vice chairman of the Islamabad Bar Council, Qamar Sabzwari, the president of the Islamabad High Court Bar Association, Shoaib Shaheen, the city’s advocate general, and a second attorney general.

At the full-court reference, Justices Mohsin Akhtar Kayani, Miangul Hassan Aurangzeb, Babar Sattar, Tariq Mehmood Jahangiri, Arbab Muhammad Tahir, Sardar Ejaz Ishaq Khan, and Samman Rifat Imtiaz were also present.
