ECP SUBMITS AN LHC INTERNAL APPEAL

The ECP has filed an appeal within the LHC to challenge the decision of a single bench regarding the immediate announcement of the election date for the Punjab Assembly.

The Election Commission of Pakistan (ECP) filed an intra-court appeal against the single bench order requiring the immediate announcement of the Punjab Assembly election date on Friday in the Lahore High Court.

Balighur Rehman, the governor of Punjab, and the Pakistan Tehreek-e-Insaf became respondents as a result.

Regarding the appellant’s role in the announcement of the election date, the commission in the appeal claimed that the single judge had neglected to take into account the provisions of the Constitution and the Election Act, 2017.

It claimed that the election date announcement was not legally required and that doing so would be against both the Constitution and the Election Act of 2017.

The commission requested that the court grant the appeal and declare the judgement from February 10 to be invalid.

In order to ensure that elections were held not later than 90 days as required by the Constitution, Justice Jawad Hassan of the LHC had ordered the ECP to immediately announce the date for the Punjab Assembly elections after consulting with the governor, who serves as the province’s constitutional head.
